Hexon Technology Pte Ltd (“Hexon”) warrants that its memory products (“Products”) are free from defects in material and workmanship.

Memory Modules

“We would like to update our partners /customers regarding our restructuring of NCP production line and its policies. We had decided to make the changes in view with the current market situation on our RMA/Warranty statement.

As of 1st Oct 2014, for all Warranty and RMA services, we have decided to replace our warranty period of limited lifetime to 3 years as of 1 October 2014 for all NCP memory products.

Elpida, HTL, Hynix and Samsung: These Products are covered by Limited One-Year Warranty from the date of purchase.

THANK YOU for both your understanding and your continuous support with NCP. Do feel free to contact your sales personnel, should you need more clarification over the warranty and RMA issues.

Flash Memory

NCP Flash memory cards: These Products are covered by by 3 years warranty from the date of purchase.

Limitations of Liability

This warranty does not apply to Product failure due to, but not limited to:

• Accident, abuse, mishandling and improper usage by user
• Natural disaster
• Insufficient or excessive electrical supply
• Abnormal mechanical or environmental conditions
• Improper usage/installation, any unauthorized disassembly, repair or modification

This warranty does not apply to Product failure as a result of usage with incompatible devices or devices not conforming to recommended industry standards.

Hexon shall not be liable for any loss of data during the use of Hexon's products.

Hexon shall not be liable for any costs incurred by the customer for troubleshooting, removing, servicing or installing Hexon's products.

Hexon will not be liable for damages resulting from a third party device that causes the Product to fail.

Hexon shall in no event be liable for any consequential, indirect, or incidental damages, lost profits, loss of business investments, loss of goodwill, or interference with business relationships as a result of lost data.

In the event of a claim, Hexon will inspect the Product and either repair or replace the Product. Subject to availability of the Product or its components, Hexon reserves the right to provide a replacement of equivalent configuration or market value or with a refurbished replacement Product

Upon Hexon's announcement of a Product's End-of-Life (EOL), the warranty of that particular Product ceases. Hexon shall not be liable for warranty repair or exchange of EOL Products.

Disclaimers

The foregoing is the complete warranty statement for Hexon products and supersedes all other warranties and representations, whether oral or written. Except as expressly set forth above, no other warranties are made with respect to Hexon products and Hexon hereby disclaims all warranties not stated herein, including, to the extent permitted by applicable law, any warranty that may exist under national, state, provincial or local law including but not limited to any implied warranty of non-infringement, merchant ability or fitness for a particular purpose.

Hexon products are not designed for use as critical components in life support equipment or for applications in which the failure or malfunction of the products would create a situation in which personal injury or death is likely to occur. Hexon shall not be liable for the death of people or any loss, damage or injury to people or property by use of products used in applications including, but not limited to, military or military-related equipment, traffic control equipment, disaster prevention systems and medical or medical-related equipment. If such use is intended, please contact Hexon for components suitable for such applications.

Hexon's total liability under this or any other warranty, express or implied, is limited to repair, replacement or refund.
